1. Agreement to terms
These Terms of Service ("Terms") are a binding agreement between you ("you", "Customer") and PurpleAILAB ("PurpleAILAB", "we", "us") governing your access to and use of the Decepticon platform, websites, APIs, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. The Service
Decepticon is an autonomous offensive-security platform that helps authorized users scope, plan, and run red-team and security-testing engagements against systems they are permitted to test. The Service may generate, execute, and report on simulated attack activity. Features, model access, and usage limits depend on your product entitlement and may change over time.
3. Authorization and lawful use (important)
You may only use the Service against systems, networks, applications, and assets that you own or for which you have prior, explicit, written authorization to test. You are solely responsible for ensuring you have all necessary permissions and for complying with the rules of engagement, scope, and any third-party program terms (for example, a bug-bounty program's policy) applicable to your testing.
You must not use the Service to access, disrupt, or test any system without authorization, to violate any law or regulation, or to cause harm. Unauthorized testing may be illegal and is strictly prohibited. You agree to indemnify us for any claims arising from your use of the Service outside an authorized scope.
4. Acceptable use
You agree not to, and not to permit others to:
(a) use the Service for any unlawful, harmful, or fraudulent purpose; (b) test or attack assets you are not authorized to test; (c) attempt to exfiltrate, retain, or misuse data you are not entitled to; (d) reverse engineer, resell, or circumvent usage limits of the Service except as permitted by law; (e) interfere with the integrity or performance of the Service; or (f) use the Service to develop a competing product.
5. Accounts and eligibility
You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old and legally able to enter into these Terms. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security or legal risk.
6. Billing, memberships, credits, and refunds
Purchases are processed through our payment provider, Polar, under the price, currency, taxes, and product terms shown at checkout. Self-serve execution requires an active Solo or Pro monthly platform membership, which renews until canceled. Monthly membership credits and separately purchased prepaid credits form one usage balance for active isolated compute and managed model usage. Additional credits may be purchased while the workspace has an active Solo or Pro membership, and customers may instead use supported customer-provided model credentials. Credits do not guarantee completion of a fixed number of engagements. Refunds are available where required by law or expressly stated at purchase. We may change future pricing prospectively with notice.
7. Customer content and data
You retain ownership of the content, configurations, targets, and results you submit or generate through the Service ("Customer Content"). You grant us a limited license to host, process, and transmit Customer Content solely to provide, maintain, secure, and support the Service. We do not use Customer Content from commercial workspaces to train or improve general PurpleAILAB models by default. Any training use requires a separate written authorization; product analytics and reliability evaluation may use aggregated or metadata-only signals that do not contain Customer Content. You are responsible for the legality of your Customer Content and for maintaining your own backups where appropriate. Our handling of personal data is described in our Privacy Policy.
8. Intellectual property
The Service, including its software, models, design, and content (excluding Customer Content), is owned by PurpleAILAB and its licensors and is protected by intellectual property laws. Except for the rights expressly granted here, no rights are transferred to you.
9. Third-party services
The Service relies on third-party providers (for example, payment processing, large language model providers, and cloud infrastructure). Your use of those features may be subject to the third party's terms. We are not responsible for third-party services.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will identify all vulnerabilities or secure any system. Security testing carries inherent risk; you are responsible for evaluating and accepting that risk within your authorized scope.
11. Limitation of liability
To the maximum extent permitted by law, PurpleAILAB will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total liability for any claim arising out of or relating to the Service will not exceed the amounts you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.
12. Indemnification
You will defend, indemnify, and hold harmless PurpleAILAB from any claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your Customer Content, or your breach of these Terms — including any testing performed outside an authorized scope.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service, other users, or third parties. Upon termination, your right to use the Service ceases; sections that by their nature should survive will survive.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be indicated by updating the "Last updated" date and, where appropriate, by additional notice. Continued use of the Service after changes take effect constitutes acceptance.
